Terms of Service

Introduction

These Terms of Service govern your access to and use of the Wayze platform, including all mobile applications, software, APIs, communication systems, and related services. By installing, registering for, or using Wayze, you agree to be bound by these Terms. Wayze is available exclusively in India and is governed by Indian law.

Definitions

  • Application: The Wayze mobile app and all associated modules, updates, and services.
  • Platform Infrastructure: All backend systems, APIs, authentication, servers, cloud services, and communication technologies used to operate Wayze.
  • User: Any person who accesses, installs, registers for, or uses Wayze.
  • Vehicle Identity Record: A digital association between a vehicle registration number and a user account.
  • Anonymous Communication Layer: A system enabling users to connect via masked VoIP calls and pre-written alerts without disclosing personal phone numbers.
  • Verification Materials: Documents submitted voluntarily for ownership verification or moderation purposes.
  • Sub-Processor:Any third-party provider engaged by Wayze to process user data on Wayze's behalf.
  • Pre-Written Alert: A standardised message template provided by Wayze that users may select and send to a vehicle owner.

Eligibility and Acceptance

By using Wayze, you enter a legally binding agreement governed by Indian law.

  • You must be at least 16 years of age.
  • You must have legal capacity to enter agreements under Indian law.
  • All information you provide must be accurate and truthful.
  • Wayze is distributed exclusively in India.

Wayze does not knowingly collect data from children under 13.

Platform Services

Wayze enables users to register vehicles by manual plate entry, search vehicle registration numbers, contact vehicle owners via VoIP or pre-written alerts, manage communication preferences, and access future platform services.

  • Wayze does not use OCR or AI-assisted number plate scanning.
  • All registration numbers are entered manually by users.
  • Users are solely responsible for the accuracy of any number they enter or search.
  • User-to-user messaging is limited to pre-defined Wayze alert templates only.
  • Wayze is not a government authority, transport registry, or enforcement body.

Account Registration

Users may register exclusively via Google Sign-In. Wayze does not maintain independent username/password credentials.

  • You are responsible for all activity conducted through your account.
  • You must keep your device secure.
  • Each person may maintain only one Wayze account.
  • Creating multiple accounts to circumvent restrictions is prohibited.

Vehicle Registration Responsibilities

Users associate vehicle registration numbers with their accounts by manual entry.

  • Wayze may impose a maximum number of vehicles per account.
  • By registering a vehicle, you confirm that any other regular drivers of that vehicle are aware they may be reachable via Wayze.
  • Vehicle owners who want to be unreachable may email contact@wayze.in to request blacklisting of their registration number.

Communication and Usage Rules

Wayze may be used only for lawful, respectful, and legitimate vehicle-related communication.

  • Harassment, threats, or abuse are prohibited.
  • Stalking, repeated contact, or misuse for non-vehicle purposes is prohibited.
  • Users may not send custom text, links, payment requests, or communications outside Wayze's pre-written alerts.
  • Impersonating government officials or law enforcement is prohibited.
  • Fraudulent documents and fake ownership claims are prohibited.
  • Use of bots, scraping tools, or automation is prohibited.
  • Creating multiple accounts to evade bans or limits is prohibited.
  • Violating any applicable Indian law through the platform is prohibited.

Wayze enforces technical rate limits on plate lookups, calls, and alerts. Circumventing these limits may result in immediate account termination.

Anti-Stalking and Enforcement

Using Wayze to stalk, monitor, or repeatedly contact a specific person is a serious violation and may also amount to an offence under Indian law.

  • Wayze may immediately terminate abusive accounts.
  • Wayze may cooperate with law enforcement under valid legal process.
  • Bans apply to the user's verified Google account identity, including Firebase UID and email.
  • Attempting to re-register after a ban is a further violation of these Terms.

Communication Systems

Wayze acts as a neutral technical communication intermediary.

  • Calls are made through a masked VoIP layer and personal phone numbers are not disclosed.
  • Outbound calls display only the caller's initials as assigned within the platform.
  • Microphone access is used only during active calls and is programmatically released when the call ends.
  • Wayze does not provide an in-app call recording feature.
  • Recording calls without all parties' consent is prohibited.

User Safety Tools

Wayze may provide safety tools such as Report Abuse, user blocking, and Ghost Mode to temporarily disable incoming contact requests. Reports may be investigated and abusive accounts may be permanently banned.

Service Availability

Wayze does not guarantee continuous uptime, instant call routing, notification delivery, or uninterrupted service. Services are provided on an "as-is" and "as-available" basis.

Emergency Disclaimer

Wayze is not an emergency service. In an emergency, call 112 or 100 using your device's native dialer. Wayze expressly disclaims all liability for reliance on the platform in emergency situations.

Subscriptions and Commercial Services

Wayze may offer free and premium features, advertising, and commercial partnerships. However, Wayze will never sell, lease, trade, or transfer your personal data, vehicle data, or verification documents to any marketing company, insurance firm, car dealership, or data broker.

Intellectual Property

All rights in Wayze software, branding, logos, algorithms, interfaces, and documentation remain the exclusive property of Wayze. No ownership rights are transferred to users.

Disclaimers

Wayze is provided "AS IS" with no warranties of reliability, ownership correctness, or real-time responsiveness. Since all plates are entered manually by users, Wayze expressly disclaims liability for communications sent to incorrect recipients due to user data entry error.

Limitation of Liability

To the maximum extent permitted by Indian law, Wayze is not liable for indirect or consequential damages, lost profits, emotional distress, property damage, parking disputes, user misconduct, service interruptions caused by third-party providers, or errors arising from manual plate entry. Total aggregate liability shall not exceed INR 1,000 or the amount paid by the user in the previous 12 months, whichever is higher.

Indemnification

You agree to indemnify and hold harmless Wayze, its officers, employees, agents, and service providers from claims, liabilities, damages, costs, and legal fees arising from your use or misuse of the platform, your violation of these Terms or any Indian law, or any third-party claim arising from your actions on the platform.

Account Termination and Deletion

Wayze may suspend or terminate accounts for policy violations, fraud, abuse, or legal compliance requirements. Users may request deletion via in-app settings or by emailing contact@wayze.in. Upon deletion, authentication access is revoked, vehicle associations are removed, and personal identifying information may be anonymised subject to legal retention requirements.

Grievance Redressal

In accordance with the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, Wayze's Grievance Officer can be reached at contact@wayze.in. Grievances will be acknowledged within 24 hours and resolved within 15 days. For unresolved matters, users may approach the Data Protection Board of India under the DPDP Act, 2023.

Governing Law and Jurisdiction

These Terms are governed exclusively by Indian law. The courts of New Delhi, India have exclusive jurisdiction. Prior to litigation, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996.

Future Features and Policy Updates

These Terms automatically extend to future services and features. Significant new features affecting user rights or material changes to these Terms will be communicated via in-app notification. Continued use after such updates constitutes acceptance.

Force Majeure

Wayze is not liable for delays or failures caused by events beyond its reasonable control, including acts of God, government actions, telecom failures, cyberattacks, or third-party provider failures.

Entire Agreement

These Terms, together with the Wayze Privacy Policy, constitute the complete agreement between Wayze and users. If any provision is found invalid, the remaining provisions continue in full force and effect.
